Terms of sale
Terms of sale
These terms of sale govern sales made on the ZAMP by RED Z online store between, on the one hand, RED Z COMPANY, a French SAS with a share capital of €1,000, registered with the Versailles Trade and Companies Register under number 827 811 936, whose registered office is at 271 rue de la Vernade, 78630 Orgeval, France, trading as “ZAMP HELMETS FRANCE” (hereinafter “ZAMP”), and, on the other hand, any individual or legal entity placing an order on the store (hereinafter “the buyer”).
They apply to all orders placed on the store. The buyer declares that they have full legal capacity and accepts the terms in force on the day of the order. The store’s legal notice is available at the bottom of every page.
1. Ordering
The buyer selects items and adds them to the cart. Before paying, the buyer checks the order summary (items, options, delivery address, shipping cost, total price) and can correct any input error. By confirming payment, the buyer accepts these terms without reservation.
A confirmation email summarising the order is sent to the buyer. The contract is concluded when this message is received. An invoice is available on request.
ZAMP reserves the right to cancel any order in the event of an existing dispute with the buyer, an obvious pricing error or suspected fraud.
2. Prices
Prices are shown in euros, including all taxes (French VAT of 20% included), excluding delivery costs. Delivery costs are displayed before the order is confirmed.
For delivery outside the European Union, any customs duties and local taxes are payable by the buyer, who must also make sure the products may be used in the destination country.
Prices and offers are valid as long as they are shown on the store. ZAMP may change its prices at any time; the price applied is the one displayed when the order is placed.
3. Payment
Payment is made online when ordering, using the methods offered at checkout (bank cards and other options shown). Payments are processed by secure providers: ZAMP never has access to the buyer’s bank details.
Products remain the property of ZAMP until the price has been paid in full.
4. Delivery
Products are delivered to the address given by the buyer, in France and in the European Union countries offered at checkout. Orders are generally shipped within 48 working hours.
Shipping costs depend on the delivery country and on the largest parcel in the order: one single rate applies per order, rates are never added together. Delivery is free in mainland France for orders of €200 or more. Details are given in the shipping policy.
In the event of a delay, ZAMP will inform the buyer as soon as possible. If delivery has not taken place within 30 days of the announced date, the buyer may cancel the order in writing and obtain a refund of the amounts paid.
The buyer checks the condition of the parcel on receipt. In the event of damage or a missing product, the buyer records precise reservations with the carrier and informs ZAMP within 3 days of receipt.
5. Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, a consumer buyer has 14 days from receipt of the product to withdraw from the purchase, without giving any reason or paying any penalty.
To exercise this right, the buyer contacts ZAMP at zamp@byredz.eu before this period expires, then returns the product within 14 days of the request, new, unused, complete and in its original packaging. Return costs are payable by the buyer.
ZAMP refunds all amounts paid, including the initial delivery costs (on the basis of the standard rate), no later than 14 days after the withdrawal. ZAMP may withhold the refund until the product has been received. The refund is made using the same payment method as the order.
The right of withdrawal does not apply to products that are personalised or made to the buyer’s specifications (for example a helmet painted or decorated at their request), nor to hygiene products unsealed after delivery (for example balaclavas or in-ear earphones). Any loss in value of a product resulting from handling other than what is necessary to check its nature (a quick try-on of the helmet, of the size) may make the buyer liable.
6. Warranties
Legal guarantee of conformity. ZAMP is liable for any lack of conformity existing at the time of delivery, under the conditions of Articles L217-3 et seq. of the French Consumer Code. The buyer has 2 years from delivery to take action. The buyer may request repair or replacement of the product free of charge; failing that, they may obtain a price reduction or the cancellation of the sale. During this period, the buyer does not have to prove that the defect existed at the time of delivery.
Guarantee against hidden defects. The buyer may also take action under the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code) within 2 years of discovering the defect, and choose between cancellation of the sale and a price reduction.
Commercial warranty. ZAMP helmets and equipment also benefit from a 2-year contractual warranty from the invoice date, on presentation of the invoice. It does not cover normal wear, impacts, or abnormal or improper use (for example paintwork not carried out to professional standards).
For any warranty claim, the buyer contacts ZAMP at zamp@byredz.eu.
7. Liability and safety
Helmets and safety equipment must be chosen in the correct size and used in accordance with the manufacturers’ instructions and the regulations of the discipline practised (FIA, SFI, Snell, CMR approvals…). It is the buyer’s responsibility to check that the product’s approval meets the requirements of their competition.
ZAMP cannot be held liable in the event of force majeure, the act of a third party or improper use of the product. Photos and visuals on the store, including configurator previews, are as accurate as possible but are not contractually binding.
8. Personal data
The data collected when ordering is necessary to process the order and manage the customer relationship. It is processed in accordance with the store’s privacy policy. The buyer has the right to access, rectify, erase and object to the processing of their data, which can be exercised at zamp@byredz.eu.
9. Intellectual property
The “ZAMP” trademark is the exclusive property of ZAMP Inc. (Boise, Idaho, USA). The texts, photos and visuals of the store may not be reproduced without permission.
10. Customer service, complaints and mediation
ZAMP customer service can be reached by email at zamp@byredz.eu, by phone on +33 (0)6 27 74 56 35 or by post at ZAMP HELMETS FRANCE, 271 rue de la Vernade, 78630 Orgeval, France.
If a dispute with customer service remains unresolved, a consumer buyer may use a consumer mediator free of charge, in accordance with Articles L611-1 et seq. of the French Consumer Code. The mediator’s contact details are available on request from customer service.
11. Applicable law
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts will have jurisdiction, subject to the protective rules the consumer enjoys in their country of residence.
These terms are written in French; in the event of any difference with a translation, the French version prevails.
